1. Acceptance of Terms
1.1. These Terms of Service ("Terms") govern your use of the focusolusi.co.id website ("Site") and the services provided by PT Focus Inti Solusi ("FIS", "we"), a limited liability company located at Jl. Pancoran Timur Raya No 41, Pengadegan, Pancoran, Jakarta Selatan 12770, Indonesia.
1.2. By accessing or using the Site and/or our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please refrain from using the Site or our services.
1.3. These Terms apply alongside our Privacy Policy. For clients with a separate license/service agreement (e.g. a software product license), the terms of that agreement shall prevail to the extent of any conflict with these Terms.
2. Our Services
2.1. FIS provides custom software development, IT consulting, and product solutions for the Finance & Banking industry ("Services"), including but not limited to application development, system integration, and post-implementation operational support.
2.2. The scope, pricing, and duration of each Service are set out in a separate agreement or proposal agreed with the client, and are not part of the general Terms of this Site.
3. Use of the Site
3.1. You agree to use the Site only for lawful purposes and in compliance with applicable Indonesian law.
3.2. You may not: interfere with or compromise the security or functionality of the Site; attempt to access restricted areas without authorization; use the Site to distribute malware, spam, or unlawful content; or copy, reproduce, or distribute Site content without our prior written consent.
4. Intellectual Property
4.1. All content on the Site — including but not limited to text, logos, images, and layout — is owned by FIS or its licensors and is protected by applicable intellectual property laws.
4.2. You may not use FIS's trademarks, logos, or other materials without our prior written consent.
4.3. Ownership of software and deliverables arising from custom development work is governed separately in the relevant client work order or license agreement.
5. Accounts and Access
5.1. If you are granted access to our systems or dashboard (e.g. as a client using an FIS product), you are responsible for keeping your account credentials confidential and for all activity that occurs under your account.
5.2. Please notify us promptly if you become aware of or suspect any unauthorized use of your account.
6. Confidentiality
6.1. We maintain the confidentiality of business information and data entrusted to us in connection with our Services, as further set out in any applicable non-disclosure agreement (NDA) or service agreement.
6.2. This confidentiality obligation does not apply to information that is already publicly available or that must be disclosed under applicable law.
7. Limitation of Liability
7.1. The Site and its content are provided "as is" without warranties of any kind, whether express or implied.
7.2. To the extent permitted by applicable law, FIS shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Site. Our liability for Services rendered under a client agreement is subject to the terms of that agreement.
